Document Description: International investment treaties and arbitration have generated serious debate about their potential, and in fact ability, to constrain the policy space and regulatory autonomy States need to protect human rights. This paper holds the view that understanding why investment treaty standards limit sovereign powers with respect to the protection of human rights requires an inquiry beginning from the history of investment protection by treaty and an assessment of the terms of investment treaties in relation to that history.
