Document Description: The WTO rules do not supersede the responsibility of States to abide by their other treaty obligations with respect to human rights. An improved coordination between the ILO, the UN human rights committees and the WTO would vastly improve the ability of individual governments to utilize human rights instruments in their attempts to adjust their trade of goods and services that are determined to have violated the fundamental human rights and core labour standards of workers.
-
Document Description: Interviews reveal labour and other abuses aboard foreign charter vessels fishing in New Zealand's EEZ.
-
Document Description: International investment treaties and arbitration have generated serious debate about their potential, and in fact ability, to constrain the policy space and regulatory autonomy States need to protect human rights. This paper holds the view that understanding why investment treaty standards limit sovereign powers with respect to the protection of human rights requires an inquiry beginning from the history of investment protection by treaty and an assessment of the terms of investment treaties in relation to that history.
-

Document Description: This paper begins by tracing the history of the boundary, before examining the interests of the respective parties and the utility and applicability of the available dispute resolution processes, including the International Court of Justice (“ICJ”). An evaluation of the legal merits of the claims is then carried out before concluding with an analysis of key elements instructing negotiations.
