Conditions of Entry

Entry into a sport and/or recreation facility operated by the University of Auckland (the University, we, our) is subject to the following conditions of entry.

1. Before entering a facility, you must:

  • disclose to front desk staff any medical conditions or concerns you have that may impact your ability to safely use or evacuate the facility
  • make any payment required to enter the facility and/or purchase goods or services at the facility published on our website and/or notified at the front desk

2. Payments will not be refunded except if required under the Consumer Guarantees Act or other law, at the discretion of the Customer Service Coordinator in exceptional circumstances, or (for members) as set out in the Membership Agreement.  This includes even if you do not use the facility, good, or service, or use it infrequently.

3. Children under 15 years will not be allowed to enter a facility except for the purpose of attending an official University event or with the express permission of a staff member. If a child is allowed to enter a facility they must be under the constant supervision of a parent/guardian or caregiver who is over 18 years.

4. You must not take any of the following into a facility:

  • bicycles, skateboards, roller blades, skates, or scooters
  • alcohol
  • food or food supplements (except for personal use)
  • animals (except certified disability assist dogs)
  • any item that is illegal or could cause harm or public nuisance

5. While at a facility you must:

  • behave in a way that is safe, courteous, and respectful of other people
  • comply with the facility’s rules and procedures including the rules for specific spaces within the facility
  • follow the reasonable requests or instructions of staff
  • comply with the University’s Code of Conduct and Campus Rules
  • respect the privacy of other facility users and staff
  • only use the facility for its designated purposes

6. While at a facility you must not:

  • photograph or video anyone at the facility without the express prior consent of every person who may appear in the images
  • carry out any activity that is illegal, offensive, or unsafe

7. Some activities at a facility may present a risk to your health and safety. You must take reasonable care for your own health and safety including by complying with the facility’s health and safety requirements, following reasonable staff instructions, using equipment correctly, reading and following signs and notices at the facility, and seeking guidance from staff when unsure. You must also take reasonable care that your actions or omissions do not adversely affect the health and safety of other facility users or staff.

8. You must take responsibility for the safety and security of personal property that you bring into a facility. You must remove personal property placed in a locker before the facility closes or before the end of any locker hire period. Personal property that is not removed from a locker when required will be removed by us and kept at Reception for 14 days. If you have not collected the personal property from Reception by the end of that period we may dispose of it.

9. You may have rights as a consumer under the Fair Trading Act 1986 and the Consumer Guarantees Act 1993 including if you pay to enter a facility and/or purchase goods or services at the facility. 10. We are not liable for any loss or damage of any kind to you or your property while at a facility unless your property is damaged, lost, or stolen by a staff member, contractor, or agent of the University, or we have liability under the Consumer Guarantees Act 1993. 

11. If you deliberately or carelessly cause damage to a facility, or equipment at a facility, we may require you to pay for the cost of repairing the damage or replacing any damaged items that cannot reasonably be repaired. 

12. These conditions of entry must be read together with the University’s Privacy Notice which sets out how we may hold, use, and disclose any personal information we collect from you when you enter and use a facility.

13. If you do not comply with these conditions of entry, we may, acting reasonably, take any or all of the following actions:

  • refuse to allow you to enter a facility
  • require you to immediately leave a facility without any refund
  • refuse to allow you future entry to a facility

If you are a member, any proposal to refuse to allow future entry will be addressed under the termination and suspension provisions of the Membership Agreement.
